OK I kinda asked this last time but this is really a new question(s) now. Here they are:
I have gotten copy right release for the majority of the professional photos I had taken of my son so that is a big big happy face!
Here are the questions:
1) I got copy right releases for all but 2009 photos taken at one professional studio. I got it for nothing:)
I could not get the 2009 because they still have it on their website until Feb 13 2011. if I do want the get the 2009 photos on to cd by them it will cost me $500.00! ($250/session with 2 sessions)!!! I cannot afford it but I love these photos! I'm thinking of waiting until March of 2011 and then asking for the copy right release. Do you think I'm being sinful?
2) we had to clean out my parents' home and I have this very old and very lovely picture of my mother when she was 22 yrs old. It is 63 yrs old. You do the math. I was able to locate the studio in the proper town as listed on the matting of the photo but what I found was a studio with the same name but having not been in business long enough to have taken this picture and their phone number is not in service. So I don't know what to do. I'd like to get it scanned and touched up because it is fading. Your thoughts on this?
That's it! Thanks for your help! Oh and by the way i would be scanning for a flash drive to be kept in the safe deposit box and then also possibly scrapbooking for my own personal purposes. Maybe even gifting the retouched photo to my mother for her birthday but not selling of course.

You might want to take it up with a priest or spiritual director.

My feeling is just my feeling.. doesn't mean it's right

but..

My feeling is if you've made the effort for an old photo and have hit brick walls in even finding the people.. that it would be ok.

And I don't know how not being able to afford to buy the copy right now is a sin.. and knowing they'll allow it for free after a time.. as long as you're not jumping the gun with saving the photos I can't see it as a sin.

I agree with Jodie, the older photo is okay to deal with right now, since you've done everything possible, and you are only doing this for personal use.

I would ask in 2011 for the other copyright and see what happens then.

I'm so glad you got releases on the other photos!

All is well! My persistence paid off. I searched a little more and found the name of the president of the company and then I found his number off of anywho and I called him. he is the grandson of the man who took my mother's picture and he gave me express permission to whatever I wanted with it and he is no longer in business. He said that my call was the furthest back call he ever got . He was born in 1948 and the photo was taken in 1947. Thank you!

I wouldn't worry about deciding to wait rather then give the company money for the copies right now.

The important thing is that you are respecting their ownership of the copyright by waiting.
