I borrowed a small Catholic booklet (under 40 pgs) that has a copyright date of 1954 in it by some brothers in a monastery. It is loooonnnnng out of print and I borrowed it because I couldn't find a copy to purchase. I was planning on having dh scan it for me. Its one of those pocket sized booklets that are so abundant in the Catholic print world.

But I'm having second thoughts now. I try really hard not to violate copyright laws. Initially my feeling was that since it was oop and I wasn't going to make a profit off of it, it was probably ok. I figured the brothers probably wouldn't mind me wanting a copy of it. But now I'm not so sure. Maybe I should just read it and return it and then keep looking for a copy for myself?

What do you think? I don't want to read something meant to be inspirational but every time I pick it up, feel guilty for copying it, kwim? That certainly defeats the purpose.

It sounds to me as if the book is probably in the public domain. Copyright Term and the Public Domain

If you can't determine from the link, I think I might feel okay making a copy with the intention to buy it if you find it. If the monastery still exists, you could always write and ask for permission.

Here's what I found on length of copyright. So basically you'd need to figure out if the copyright was renewed. If not the book is in the public domain and it would be completely legitimate to copy.

1923 through 1963
Published with notice but copyright was not renewed
In the public domain due to copyright expiration

1923 through 1963
Published with notice and the copyright was renewed
95 years after publication date

Thank you for the information on public domain. That it really helpful. It turns out the Order is easy to find online, so I sent an email to them. We'll see what they say. I wonder if they are going to say, "What booklet? We've never heard of that!"

Books, there is a place to find out if it was renewed.

Copyright Renewals

Anything after 1964 had an automatic renewal. So this booklet falls into the questionable period.

It's been interesting doing some copyright renewal searches. I've found that some existing companies say they have renewed, but when searching, I haven't been able to find that.

I think there is room in the copyright law copying for classroom purposes, and not for resale.

Thanks, Jenn. The booklet in question doesn't show up in the search. It honestly wouldn't surprise me if its public domain. I just don't want to assume that, either. I guess I'll wait and see if I hear from the Order.

Unfortunately, the item in question is for private use, so I don't think I can justify it as a classroom purpose.

Is it possible to write to the publisher to ask for permission? (I am guessing that you are unable to contact the publisher.) Years ago I wrote to Benzinger for permission to copy several books that were oop and they wrote back granting the permission.

Please let me know what happens! I have appreciated all the ideas here and feel I will one day need to come back to this thread for links and reminders.
