Please pray for a Legislative Bill (1141) that is being proposed by a Senator Diane Schimek. It is a horribly scary proposal. Particularly frightening are #'s 3 and 8. This is just an overview. The evil details are so vague,leaving much to be determined *only* by so called experts. To learn more you can go to Nebraska.gov. Prayers are needed so that this doesn't reach further than the Education Commitee(Feb.26). It could be devastating if it hits the floor. Some are comparing her proposal to state child abuse. If you look at #3, that could mean very young children could be taken from their homes and forced to go to school!

Below is an abbreviated analysis of LB 1141:

1) Currently, subsequent to filing Rule 12/13 materials, we receive an acknowledgment from the Commisioner of the NE Dept. of Education that he has received a request to file as an exempt school. LB 1141 adds a requirement that the Commissioner "approve" of the Rule 12/13 application.

2) Annually, every child which attends an exempt school will be required to a) take a standardized test OR b) submit materials to the Dept. of Education to determine whether the student is making sufficient academic progress.

3) A child who is at least six years of age who is being home schooled for the first time MUST take a test to obtain educational baseline data. Simply put, they want to test your child BEFORE they are homeschooled to determine what he/she knows. This information will likely be used to determine whet


her the student, subsequent to the first year of schooling, is making adequate progress.

4) As for the annual mandatory testing, it will be conducted by a "certified educator of a school district." The test must be a "nationally recognized standardized achievement evaluation" or "another assessment tool developed or approved by the commissioner and chosen by the child's parent...from a list of approved evaluations or assessment tools...."

5) In lieu of taking the test, a parent may submit, as eveidence of adequate academic progress, ALL of the following, including:a book of lesson plans, a portfolio of the child's work, including an outline of the curriculum, copies of homework completed, examples of the student's classroom work, as well as numerous other materials.

6) If a parent submits materials in lieu of the testing, the materials will be reviewed by an "evaluator" approved by the Dept. of Education.

7) Each student must show sufficient progress of academic achievement. Sufficient progress is defined in the bill to mean having achieved the equivalent of 6 months of academic progress in the grade level of the student and having evaluation scores equal to the grade level for which the student is placed according to his/her age-group peers in the public school system.

8) If the student fails to make sufficient progeress. he/she MUST be enrolled in an accredited school the following year UNLESS: before the beginning of the next school year, the student takes the test again and shows sufficient progress; the child demonstrates sufficient progress in the opinion of an evaluator approved by the Dept. of Ed.; or the Commissioner grants approval for the student to continue "under a plan for remediation determined by the department."

Vermont has very strict guidelines that are very similar to the above proposal. We do have to have our kindergarten aged children tested by teachers at the public school in our own districts. We must submit portfolios or standardized testing, or other options once a year.

A side note about this: Our Dept. of Ed. has a home schooling evaluator and she has homeschooled for 13 years. They are very helpful and encouraging.
